BALI BUMI TERMS OF SERVICE & PRIVACY POLICY

PART I: TERMS OF USE
1. LEGAL AGREEMENT & ACCEPTANCE 1.1 These Terms and Conditions constitute a legally binding agreement between Bali Bumi (“the Company”, “We”, “Us”) and the User (“You”). 1.2 By accessing the Application, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must immediately cease all use of the Application.
2. ELIGIBILITY & REGISTRATION 2.1 Age Requirement: You must be at least 18 years old and possess the legal capacity to enter into binding contracts under Indonesian law. 2.2 Account Security: Users are solely responsible for maintaining the confidentiality of their credentials. Any activity performed via your account is deemed your own responsibility. 2.3 AML/KYC Compliance: Bali Bumi reserves the right to request identity verification to comply with Anti-Money Laundering (AML) and Know Your Customer (KYC) regulations.
3. SCOPE OF REAL ESTATE SERVICES 3.1 Information Platform: Bali Bumi provides a digital marketplace for land, villas, and off-plan properties. We act as a facilitator, not as the legal owner or official representative of all listed properties. 3.2 No-Reliance Clause: All listings (including prices, sizes, and descriptions) are provided for informational purposes. While we strive for accuracy, Bali Bumi does not guarantee that the information is error-free. 3.3 Mandatory Due Diligence: The User is strictly obligated to conduct independent legal and technical due diligence (zoning/ITR, land certificates/SHM/HGB, and building permits/PBG) before any transaction.
4. OFF-PLAN DEVELOPMENTS & RISKS 4.1 Developer Liability: For properties sold before completion (“Off-Plan”), the legal obligation to build and deliver rests solely with the third-party Developer. 4.2 Limitation of Responsibility: Bali Bumi is not liable for construction delays, deviations from architectural renders, or the financial insolvency of third-party developers.
5. LIMITATION OF LIABILITY & INDEMNITY 5.1 “As-Is” Basis: The Application is provided without any warranties of any kind. 5.2 Liability Cap: In no event shall Bali Bumi’s total liability exceed the total fees paid by the User to the Company during the 12 months preceding the claim. 5.3 Indemnification: You agree to indemnify Bali Bumi against any claims, losses, or legal fees resulting from your breach of these Terms or your violation of Indonesian laws.
PART II: PRIVACY & DATA PROTECTION (PDP LAW COMPLIANCE)
6. DATA CONTROLLER & COLLECTION 6.1 Data Controller: Bali Bumi is the controller of your personal data under Law No. 27 of 2022. 6.2 Data Collected: We collect Identity Data (name, nationality, contact details), Technical Data (IP address, cookies, device metadata), and Acquisition Data (property preferences and search history).
7. PURPOSE & LEGAL BASIS OF PROCESSING 7.1 Contractual Necessity: To provide property acquisition follow-up and management services. 7.2 Legal Obligation: To comply with Indonesian tax and real estate reporting requirements. 7.3 Consent: By using the Application, you provide explicit consent for the processing of your data as described herein.
8. DATA SECURITY & STORAGE 8.1 Security Infrastructure: Your data is hosted within a secure Google Cloud environment and encrypted using industry-standard AES-256 protocols. 8.2 Retention Policy: Personal data is retained for a period of five (5) years following your last interaction, in accordance with Indonesian statutes of limitations for commercial records.
9. THIRD-PARTY DISCLOSURE 9.1 Authorized Sharing: We share data with third parties (Notaries/PPAT, legal consultants, or developers) only when strictly necessary to execute a transaction requested by you. 9.2 No Sale of Data: Bali Bumi does not sell, rent, or trade your personal data to third-party marketing agencies.
10. DATA SUBJECT RIGHTS 10.1 Pursuant to the UU PDP, you have the following rights:

Right to Access: Request a copy of your stored data.

Right to Rectification: Update inaccurate or incomplete information.

Right to Erasure: Request the deletion of your account and data (“Right to be Forgotten”).

Right to Withdraw Consent: Revoke your consent for data processing at any time. 10.2 To exercise these rights, contact our Data Protection Officer at contact@balibumi.com.
PART III: GENERAL PROVISIONS
11. INTELLECTUAL PROPERTY 11.1 All content, including architectural renders, logos, code, and text, is protected by Indonesian Copyright Law. Any unauthorized use or “scraping” is strictly prohibited.
12. GOVERNING LAW & DISPUTE RESOLUTION 12.1 These Terms are governed by the Laws of the Republic of Indonesia. 12.2 Any dispute that cannot be settled amicably shall be submitted to the exclusive jurisdiction of the District Courts of Indonesia (Pengadilan Negeri).
13. AMENDMENTS 13.1 Bali Bumi reserves the right to modify these Terms at any time. Amendments become effective immediately upon posting. Your continued use of the Application signifies acceptance of the revised Terms.
